General Travel Terms and Conditions

1. basics of the contract

Bookings are only accepted on the basis of the General Contractual and Travel Conditions printed below. By making a booking to Mesoamerica Tours (hereinafter abbreviated to "MT"), the customer agrees to our General Terms and Conditions of Contract and Travel. 2. bookings/conclusion of contract

2. bookings/conclusion of contract

2.1 Upon acceptance of a written, telephone or personal booking, a contract is concluded between the customer and MT.

2.2 The booking must state the full name and age of the travel participants. Furthermore, the travel date as well as the dates of the outward and return flights must be stated.

3. prices and payment terms

3.1 All prices are net prices and payable in Euro. Invoice deductions shall be charged subsequently.

3.2 The invoice shall be deemed to be the order confirmation.

3.3 To guarantee a booking, a deposit of 25% of the invoice amount must be paid, which is due immediately upon receipt of the invoice/order confirmation.

3.4 The entire invoice amount must be credited to MT's bank account no later than 30 days prior to departure.

3.5 In the case of short-term bookings (i.e. less than 30 days prior to departure), full payment is due immediately upon receipt of the invoice/order confirmation.

3.6 In the event of an invoice value of less than EUR 250, MT shall charge a handling fee of EUR 25.

3.7 Price increases due to unforeseeable events such as domestic airline tickets and government tax increases may be subsequently charged by MT.

3.8 There shall be no entitlement to commencement of travel without prior and full payment.

4. travel cancellation / handling fees

4.1 The customer may withdraw from a booked trip at any time. The date of the notice of withdrawal to MT is decisive for the costs. This must in any case be made in writing, taking into account the following compensation to MT - unless otherwise stated in the order confirmation:

4.2 In case of cancellation up to 30 days prior to departure, a handling fee of 25% of the invoice amount, but at least 50 euros per passenger, will be charged.

4.3 In the event of cancellation between 29 and 15 days before the start of the trip, a compensation of 50% of the invoice amount, but at least 100 euros per passenger, will be charged.

4.4 In the event of cancellation between 14 and 7 days before the start of the trip, a compensation of 50% of the invoice amount, but at least 150 euros per passenger, will be charged.

4.5 In case of cancellation 6 days or less before the start of the trip or for non-participation, the full invoice amount will be charged or no money will be refunded.

5. Transport

5.1 In the case of transportation services, in particular domestic flights, rental cars, buses and boat trips, MT acts only as an agent for third-party services.

5.2 Otherwise, the means of transport used by MT depend on the number of tour participants and weather conditions. For visits to national parks or off-road routes, all-wheel drive vehicles suitable for off-road use will be used in some cases. This may limit the comfort of the tour participants.

5.3 All domestic flights will be operated by local airlines. The airline will be determined by MT. General terms and conditions of contract and travel

6. equipment

6.1 MT will provide the customer with sleeping mats, life jackets, mosquito nets, harnesses and a first aid kit for trips to jungle areas or national parks.

6.2 For expeditions, the special travel conditions or requirements for the travel participants must be strictly observed.

7. limitations of liability

7.1 MT guarantees the careful selection/control of contractual partners such as hotels, airlines, car rental companies.

7.2 MT is explicitly not responsible for delays or cancellations of international and national flights, technical problems of rental vehicles, unforeseen incidents resulting from natural phenomena or personal problems of the customer. Also, MT cannot be held responsible in case of accident, illness or theft of passengers' personal belongings.

7.3 MT reserves the right to exclude travelers who demonstrably endanger the performance of a trip due to actions, personal, physical and/or psychological characteristics.

7.4 MT further reserves the right not to carry out a trip or parts thereof if there are dangers for the trip participants.

8. complaints

8.1 Should a trip not be able to be carried out according to the program for reasons for which MT is not responsible, MT shall provide an alternative corresponding to the booked trip.

8.2 Should general or specific problems arise regarding the quality of the trip being carried out, the deficiencies must be reported immediately. This will ensure a quick and unbureaucratic improvement in the interest of the customer while the trip is still in progress.

8.3 If no satisfactory solution can be found for the travel participant, a written complaint must be submitted to MT by no later than 14 days after the end of the trip.

8.4 The quality control questionnaire completed by travel participants does not serve as a formal complaint.

9. recommendation

MT recommends that all travelers take out personal travel accident, repatriation, theft, trip interruption and trip cancellation insurance, which also covers all cases for Covid 19 illnesses and quarantine periods.

10. travel documents, visas, vaccinations

MT's contractual partner is responsible for compliance with all regulations applicable to the execution of the trip. MT cannot accept any liability for refusal of entry due to visas not obtained or received. MT's contractual partner alone is responsible for compliance with the prescribed passport, visa, customs, vaccination, foreign exchange and health regulations.

11. Applicable Law / Place of Jurisdiction

Honduran law is exclusively applicable in the contractual relationship between the customer and MT. Legal action against MT may only be brought at the head office in San Pedro Sula, Honduras.
